HC allows Sushant Singh Rajput’s father to approach single judge on film’s release

The Delhi High Court on Monday granted liberty to Sushant Singh Rajput’s father to approach a single judge with his grievances regarding the release of a film based on the late Bollywood actor’s life. A bench of Justice Rajiv Shakdher and Justice Tawant Singh said both the parties are free to present their case before a single judge as the film ‘Nyay: The Justice’ has now released on the digital platform. The bench was hearing an appeal filed by Rajput’s father Krishan Kishore Singh against a single-judge order refusing to stay the film’s release.

Disposing of the appeal, the Bench said, “The arguments of the appellant (Krishna Kishore Singh) will be examined in the background of the film which is available on Lalaplap’s original website.”

It clarified that if the makers of the film are going to make any changes, the information will be conveyed to Singh, who will be free to approach the single judge if he advises.

Senior advocate Vikas Singh, appearing for the late actor’s father, argued that the makers had given fraud and perjury as he had made a “completely false statement on oath” relating to the film’s release on June 11.

The senior advocate submitted that 72 minutes of content was missing in the video uploaded on the digital platform and it was only “an assortment of shootings” which cannot be termed as a film release.

The bench said Singh would be free to file a review of the single-judge order on these grounds if he believes that fraud had taken place.

Senior advocate Chander Lal, appearing for the filmmaker, replied that the actor’s father cannot act as a judge of the quality of the film. “Who is it (Krishna Kishore Singh) who decides what the quality of a film should be? Good or bad, it’s there. Lal argued that he claimed that over three lakh people had already seen the film online and that empty gaps were provided to accommodate any advertisements.

He also said that the order of the Single Judge, which was challenged before the court, was passed before the release of the film and therefore, in terms of the order, any complaint should be raised before the Single Judge after the release. .

Last month, a vacation bench of the High Court had issued notice on Rajput’s father’s appeal against a single judge’s order refusing to stay the release of several films, including “Nyay: The Justice”.

An application was also filed by him, claiming that the film’s release on the digital platform was “nothing but a sham” as it was “incomplete, completely blurred, blurred and hazy”.

However, the High Court refused to pass any interim order stopping the further publication of the film.

The single judge had earlier said that it has found merit in the productions of the producers and directors that if the information about the incidents is already in the public domain, then no one can request infringement of right to privacy on a film inspired by such incidents could.

Some upcoming or proposed film projects based on his son’s life are “Nyay: The Justice”, “Suicide or Murder: A Star Was Lost”, “Shashank” and an unnamed crowd-funded film.

The High Court had directed the filmmakers to submit a full account of the revenue earned from the films, if any case of loss arises in future and to list the suit before the Joint Registrar for completion of the petition.

The suit claims that if “film, web-series, book or any other similar material is allowed to be published or broadcast, it would affect the right of the victim and the deceased to a free and fair trial because This may be the reason for this bias towards them”.
