Consenting adults free to live together: Allahabad HC on live-in relationships

Prayagraj: The Allahabad High Court (HC) has held that two adults have the freedom to live together and no person should be allowed to interfere in their peaceful ‘live-in relationship’. In this major decision, the court quashed the FIR lodged by the father of a girl in Jaunpur district of Uttar Pradesh.

A division bench of the Allahabad High Court comprising Justice Sunit Kumar and Justice Syed Waiz Mian relied on a judgment of the apex court which had held that live-in relationship It is legal between consenting adults if the requirements for marriage such as legal age of marriage, consent and stability of mind are met.

The top court had said that no rule allows or prohibits such connections.

s. In the landmark case of Khushbu vs Kanniammal, the apex court held that a live-in relationship comes within the right to life under Article 21 of the Constitution. The constitution of IndiaIt provides that no person shall be deprived of his life and personal liberty except according to procedure established by law.

The court also said that live-in relationships are permitted, and the act of two adults living together cannot be considered “unlawful” or “illegal”.
