Bombay HC dismisses IPS Rashmi Shukla’s plea to quash FIR in phone tapping case

The Bombay High Court on Wednesday directed the Maharashtra government to give seven days’ notice to senior IPS officer Rashmi Shukla if any coercive steps are to be taken against her in connection with the alleged phone tapping and leak of sensitive documents. A division bench of Justice Nitin Jamdar and Justice Sarang Kotwal also dismissed a petition filed by Shukla seeking quashing of the FIR registered by Mumbai Police and transfer of the case to the Central Bureau of Investigation (CBI).

His name is not in the FIR. Shukla, who is currently serving as ADGP, CRPF (South Zone) and posted in Hyderabad, headed the Maharashtra Intelligence Department at the time of the alleged phone tapping last year. The bench said, “Both the prayers – quashing of the FIR and transfer of the case to CBI are dismissed. If the State Government intends to take any coercive step against the petitioner (Shukl), it shall give seven days’ notice to the petitioner.” Will give.” ,

The bench passed the order on a petition filed by Shukla. In October this year, the Maharashtra government had told the HC that Shukla was not named as an accused in the case, but there is material against him to investigate.

Shukla, in his plea, had alleged that he was being made a scapegoat and was being targeted by the Maharashtra government for submitting a report on alleged corruption in police transfers and postings. The petition further states that the state intelligence department, which she was heading at that time, had taken necessary permission from the Additional Chief Secretary, Government of Maharashtra, before monitoring.

In his plea, Shukla said he had exposed alleged nexus between ministers and politicians and other gross corruption involved in handing over postings to police officers. In March this year, an FIR was registered at Mumbai’s BKC Cyber ​​Police Station against unidentified persons for allegedly illegally tapping phones and leaking certain confidential documents and information.
