Public Prosecutor Shekhar Shetty said retired teacher Theresa D’Souza gave pension amount for the years 2006-07 and 2008-09 to her relative Gracie Fernandez and asked her to deposit it in her account in a nationalized bank branch. A few days later, when Theresa checked her account details, she found that she had only Rs 15,571 in her account instead of Rs 5.4 lakh. When she went to Gracie’s house to inquire about the amount, the accused and her husband threatened her. Based on the complaint, the accused has been arrested and charge sheet has been filed. In November 2016, Gracie was acquitted by the second additional senior civil judge and chief judicial magistrate.
Allowing the appeal by the state government, he was jailed for four years and fined Rs 12,000 for an offense punishable under various sections of the IPC. He was also sentenced to two years and a fine of Rs 2000 for the offense punishable under IPC section 379 (punishment for theft) and one year and Rs 1,000 for the offense of section 465 (punishment for forgery) of IPC Was. All the sentences will run concurrently. Out of the total fine amount, Rs 10,000 will be given to the retired teacher as compensation.
