Assam Court Summons Sisodia In Defamation Case Filed By Sarma | Guwahati News – Times of India

Guwahati: A local court in Assam has served summons to Delhi deputy chief minister Manish Sisodia, asking him to appear before it on September 29 in a criminal defamation case filed by Assam CM Himanta Biswa Sarma.
Kamrup chief judicial magistrate Monmee Sarma, in her order, stated that “prima facie it is seen that some derogatory remarks are made by the accused person against the complainant which, if not true, can malign the reputation of the complainant.”
The judge took cognizance of Sarma’s complaint under Section 499 of the IPC, which relates to “defamation” by words either spoken or intended to be read, or by signs or by visible representations, and under Section 500 of IPC that relates to punishment for defamation and provides for punishment with simple imprisonment for a term that may extend to two years, or with fine, or with both if found guilty.
Sarma’s counsel Kishor Kumar Dutta said, “Since this is a criminal defamation case, the respondent (Sisodia here) has to appear before the court in person.”
The chief minister had appeared before the chief judicial magistrate on August 5 and gave his initial deposition in the criminal defamation case.
