Aryan Khan Drugs Case: NCB files response against Shahrukh Khan’s son’s bail plea; here’s what it reads

The superstar’s son was arrested after the NCB busted an alleged drugs party on the Cordelia cruise ship, which was on its way to Goa. After the bail was rejected in the special NDPS court, Aryan’s lawyers filed a bail plea in the Bombay HC against the court’s order. Meanwhile, the probe agency alleged that the 23-year-old was not only a consumer of drugs but was also involved in illegal drug trafficking. Not only this, NCB even claimed that Aryan and Shah Rukh’s manager Pooja Dadlani is tampering with evidence and witnesses in an attempt to derail the investigation.

Aryan Khan’s advocates, on the other hand, submitted an additional note to the HC, stating that he had nothing to do with the allegations and counter allegations being circulated between NCB Zonal Director Samir Wankhede and some political figures. The NCB on Tuesday filed its affidavit in the HC in response to the bail plea filed by Aryan Khan.

A single bench of Justice NW Sambre is likely to take up the petition for hearing later in the day. The anti-narcotics agency in its affidavit said that an attempt is being made to tamper with the ongoing investigation with the malafide intention to derail the investigation in the case.

Referring to the allegations of attempt of extortion by SAIL, an independent witness in the case, the agency said, “This is evident from the contents of an alleged affidavit of Prabhakar SAIL.”

The affidavit also referred to Pooja Dadlani and said, “This woman appears to have influenced the five witnesses during the course of the investigation.”

The NCB said the bail plea was “false and misconceived”.

It said that the investigation so far in the case has exposed Aryan Khan’s role in illegal purchase, transportation and consumption of drugs.

The agency said that prima facie investigation has revealed that Aryan Khan used to purchase drugs from his friend Arbaaz Merchant, who is also an accused in the case.

“The applicant (Aryan Khan) was in contact with certain persons abroad who appear to be part of an international drug network for illegal purchase of drugs,” the petition said.

The affidavit further states that even though there has been no recovery from Aryan Khan, he “participated in the conspiracy”.

“Prima facie investigation has revealed that this applicant is not merely a consumer of drugs, as desired by him,” it said.

The NCB stated that the applicant has not made any case for extension of bail, prima facie and/or otherwise.

The affidavit said, “The role of this applicant (Aryan Khan) in serious and serious offenses including illicit drug trafficking under the NDPS Act is evident, in view of the nexus and connection of this applicant with other accused in the matter, The affidavit stated.

It added that a moderate quantity of drugs have been recovered from the other accused in the case and hence, Aryan Khan’s case cannot be looked at separately.

“The elements of the conspiracy are clear and clear,” the affidavit said. In such cases the quantum of recovery of drugs from an accused becomes irrelevant.

The NCB also said that it is still probing the matter and charge sheet needs to be filed.

It said that the agency needs sufficient time to properly investigate the international relations so as to approach the concerned foreign agency through proper channel, which will take some more time.

Meanwhile, Aryan Khan’s advocates submitted an additional note to the HC, stating that he had nothing to do with the allegations and counter allegations being circulated between the zonal director of NCB Wankhede and some political figures.

“The applicant (Aryan Khan) does not make any allegation against any person in the prosecution department,” the note said.

It further said that Aryan Khan has no connection with Prabhakar Cell, an independent witness in the case, who has alleged attempted extortion against Wankhede and others.
