Anil Deshmukh seeks default bail in corruption case, claims CBI chargesheet ‘incomplete’

Anil Deshmukh corruption case: Former Maharashtra home minister and NCP leader Anil Deshmukh on Wednesday sought default bail from a special court in a corruption case against him. CBI is investigating the matter. Deshmukh also claimed that the probe agency has filed an “incomplete” charge sheet in the case.

“By filing only, a compilation of 59 pages, called chargesheet, without completing the full investigation and without filing the final and complete chargesheet, as understood under section 173 CrPC, the prosecuting agency shall not be subjected to indefinite statutory authority for claiming default bail of the applicant,” the petition said.

The CBI last week filed a 59-page chargesheet in the corruption case against NCP leader Deshmukh and his two former aides Sanjeev Palande and Kundan Shinde.

Deshmukh is currently in judicial custody in the money laundering case being probed by the Enforcement Directorate (ED). He is lodged in Arthur Road Jail in Mumbai.

Section 173 of the Code of Criminal Procedure (CrPC) deals with the report of a police officer on completion of investigation in a case.

Former Mumbai Police Commissioner Param Bir Singh alleged in March last year that Deshmukh, who was then the state’s home minister, had given police officials a target of collecting Rs 100 crore per month from restaurants and bars in the city.

Deshmukh denied the allegations, but resigned from his post after the Bombay High Court directed the CBI to register a case against him.
