The Bench ruled that the petitioners satisfy the eligibility requirements and are confirmed by the Executive Council on completion of their probationary period

The Allahabad High Court on Friday set aside the order of Dr Shakuntala Mishra University that had dismissed five teachers after seven years of service.

The Lucknow bench of the High Court said in its order that the university did not follow the legal process and did not listen to the teachers before sacking them.

A division bench of Justice Alok Mathur delivered the verdict on the writ petitions filed by the teachers.

The teachers – Rajendra Kumar Srivastava, Vipin Kumar Pandey, Mrityunjay Mishra, Adya Shakti Shakti Rai and Awanish Chandra Mishra – had challenged the termination order dated July 6, 2022. The bench observed that the petitioners fulfilled the eligibility criteria and were confirmed by the Executive Council after completing their probationary period.

The bench said, “This Court is of the considered opinion that after allowing a person to continue in service for a long period of time, the selection cannot be set aside, or the services cannot be terminated because of some defect in the selection “

The bench directed the university to immediately reinstate the petitioners and also pay them salary from the date of dismissal.
