A lot of burden on our shoulders, the Supreme Court said after dismissing the case transfer petition

A Bench said that just because the HC is not listing the matter, does not mean that the SC should transfer it to itself.

The Supreme Court on Friday dismissed a plea seeking transfer of a case pending in the Punjab and Haryana High Court to the apex court, saying “we have a substantial burden on our shoulders” and did not want to add to it.

A bench of Justices DY Chandrachud and BV Nagarathna said that just because the High Court is not listing the matter, it does not mean that the apex court should transfer it to itself.

“We don’t want to add to our burden. We have a lot on our shoulders.”

“The High Courts are busy with work,” the bench said, “Since the High Court is not listing a matter, we should transfer it. What kind of argument is this.”

The counsel for the petitioner submitted that the apex court is considering a similar matter and the parties involved are also the same. The bench said the apex court is dealing with the matter relating to liquor vends on highways, while the petition pending before the high court pertains to access control of highways.

The top court said that many new highways now have access control and this is important as the highways pass through villages and towns. “Parts of Delhi-Mumbai highway are being controlled. These are all policy matters. We will not move it,” the bench said.

Dismissing the petition, the bench said it cannot transfer the cases just because the High Court is not listing it.
