प्रकाश सिंह बादल को धोखाधड़ी केस में क्लीन चिट: सुप्रीम कोर्ट ने कहा- निचली अदालत का जारी समन कुछ नहीं, सिर्फ कानून का दुरुपयोग

The Supreme Court on Friday gave a clean chit to Shiromani Akali Dal’s (SAD) Parkash Singh Badal in a cheating case, two days after his death. The names of Sukhbir Badal and Akali leader Daljit Singh Cheema were also involved in this case. The court has quashed the case.

A bench of Justices MR Shah and CT Ravi Kumar had on April 11 reserved the order on the petition filed by Parkash Singh Badal and senior Akali leader Daljit Singh Cheema. Today, the Supreme Court set aside the summons issued by the trial court in Hoshiarpur, Punjab, which was also upheld by the Punjab and Haryana court.

Justice Shah, who pronounced the judgment on behalf of the bench, said- The summoning order passed by the lower court against the appellants is nothing but an abuse of the process of law.

Social activist Balwant Kheda filed a complaint
In 2009, a complaint of cheating was filed in the Hoshiarpur court by social worker Balwant Singh Kheda. In which it was alleged that SAD has 2 constitutions – one has registered the Gurdwara Election Commission for the management of Gurdwaras, while the other has registered the Election Commission as a political party. He argued that this amounts to cheating.

After the trial court issued summons, the Badal family and Cheema moved the Punjab Haryana High Court. The High Court upheld the order of the lower court. After which the Badal family and Cheema approached the Supreme Court in August 2021.
