The Supreme Court has observed that death row prisoners are taking advantage of the delay in disposal of mercy petitions. Actually, these prisoners demand reduction of their sentence on the basis of delay in decision on mercy petition.

The Supreme Court has directed the state governments and the officers who decide on mercy petitions to decide and dispose of these petitions at the earliest. So that the guilty also knows what is going to happen to him and the victim also gets justice. Also, the guilty should not be able to take advantage of this.

Death penalty defeats very purpose: SC
The Supreme Court said these things during the hearing on a petition by the Government of Maharashtra. The Maharashtra government had challenged the Bombay High Court’s decision to commute the death sentence of two sisters to life imprisonment in the SC.

The mercy petition of these sisters was pending with the Government of Maharashtra and the Governor for 7 years and 10 months. No decision was taken on this. For this reason, the High Court had converted the death sentence to life imprisonment.

The Supreme Court said that while commuting death sentence to life imprisonment, the seriousness of the crime should be considered. Along with this, the time taken in disposal of mercy petition should also be seen. On this basis, the court refused to make any change in the decision of the High Court.

On behalf of the Central Government, Additional Solicitor General Aishwarya Bhati said that in view of the crime of the convicts, the High Court should have sentenced them to life imprisonment till the last breath. After this, the Supreme Court changed the sentence. Now both the sisters will remain in jail till their last breath.

Both filed a mercy petition with the Governor of Maharashtra, which was rejected in 2012-13. After this, a mercy petition was filed with the President in 2014, that too was turned down. After this, both the sisters again reached the Bombay High Court. He demanded the court to commute the death sentence to life imprisonment saying that there has been a lot of delay in deciding his mercy petition. She has gone through mental torture because of living in fear of death.

The Bombay High Court observed that the state government was lax in disposing of the mercy petitions of the two and commuted their death sentences to life imprisonment.
