A hearing was held in the Supreme Court on a petition against the Election Commission giving the name and party symbol of Shiv Sena to the Shinde faction. A bench headed by Chief Justice DY Chandrachud refused to stay the Election Commission’s decision. However, on Uddhav’s petition, issued a notice to the Shinde faction and the Election Commission, seeking a reply within two weeks.

Here, NCP Chief Sharad Pawar said that the Election Commission did what the government wanted. The commission has been misused. We have never seen such a decision of the Election Commission. Balasaheb Thackeray had said in his last days that after him Uddhav Thackeray would be given the responsibility of Shiv Sena.

On the other hand, Aam Aadmi Party’s Shaili Oberoi was elected as the Mayor of the Municipal Corporation of Delhi (MCD). Shelly got 150 votes in the mayoral election held 80 days after the MCD elections. He defeated BJP’s Rekha Gupta by 34 votes. Delhi has got a woman mayor after 10 years. Earlier in the year 2011, BJP’s Rajni Abbi was elected mayor. After this 2012 the corporation was divided into 3 parts.

1. Uddhav faction has no relief from SC, seeks response from Shinde and Election Commission within 14 days

A bench of CJI DY Chandrachud, Justice PS Narasimha and Justice JB Pardiwala said that the Shinde faction has proved itself before the Election Commission. In this situation, we cannot stay the order of the Election Commission right now. Senior advocate Kapil Sibal, on behalf of the Uddhav group, said that the Shinde group is occupying the party office and bank accounts. In such a situation, the court should issue a stay order.

The court said that the Uddhav camp can continue to use the temporary name and election symbol it has got so far. In fact, the court gave this decision in view of the Maharashtra Assembly by-elections to be held on February 26. The court told the Shinde group that AAP too would not issue such a whip as of now, disobeying which would disqualify the pro-Uddhav MPs and MLAs.

3. Shaili will remain mayor of Delhi for 38 days only, will be able to work till March 31, elections will be held again on April 1

Shaili Oberoi, Mayor of Municipal Corporation of Delhi, will be able to remain in this post only for 38 days. In fact, as per Section 2(67) of the DMC, the year of a corporation begins on the 1st of April and ends on 31st March of the following year.
